Code of Maryland Regulations

State agencies with the authority to adopt regulations must follow the State's Administrative Procedures Act, State Government Article, ยง10-101 et seq., Annotated Code of Maryland, when adopting regulations. These requirements include review by the Maryland General Assembly's Administrative, Executive, and Legislative Review Committee, publication in the Maryland Register, and public comment on proposed new regulations and changes to existing regulations.

The Code of Maryland Regulations (COMAR) is organized by title, with the name of title corresponding to the name of the agency with authority to adopt regulations. For example, the State Board of Elections is authorized under section 2-102 of the Election Law Article to adopt regulations to implement its powers and duties. Regulations adopted by the State Board of Elections are located in Title 33 - State Board of Elections of COMAR.

The State's Division of State Documents publishes COMAR in two formats. The Division has an online, searchable version of COMAR and sells a printed version. The online version is updated as soon as a proposed regulation is effective, and updates to the printed version are printed bi-annually.

Board Meeting - Tuesday, June 25, 2024 at 2:30 PM

A Notice of Proposed Action was published in the August 9, 2024 issue of the Maryland Register for the proposed amendments to:

  1. Regulation .01, .03, and .05 under COMAR 33.03.02 Copies of Registration Lists
  2. Regulation .02 under COMAR 33.05.02 Voter Registration Applications
  3. Regulation .05 under COMAR 33.17.06 Early Voting Activities

These notices of proposed action are open for a 30 day comment period which will end September 9, 2024. Comments may be sent to Danyelle Avery, Administrator of Election Reform, State Board of Elections, P.O. Box 6486 Annapolis MD 21401-0486, or call 410.269.2840, or email to [email protected]. A public hearing has not been scheduled.

Additionally, at its June meeting, the State Board also initiated approved amendments to:

  1. Regulation .02 under COMAR 33.04.01;
  2. Regulation .07 under COMAR 33.04.01; and
  3. Regulation .03 under COMAR 33.04.02.

These proposed actions will be published in the September 20, 2024 Maryland Register and will be open for public comments.

State Board Meeting - Thursday, February 22, 2024 at 1:30 PM

A Notice of Proposed Action was published in the March 8, 2024 issue of the Maryland Register for the proposed amendments to Subtitle 11 only, for a 30 day comment period, which concluded on April 7, 2024. For the remaining proposed amendments, a Notice of Proposed Action was published in the June 30, 2023 issue of the Maryland Register for a 30 day comment period, which concluded on April 5, 2024.

Additionally, at its February meeting, the State Board also approved:

  1. Regulation .06 under COMAR 33.11.03;
  2. Regulation .03 under COMAR 33.11.04;
  3. Regulation .04 under COMAR 33.11.05; and
  4. Regulation .04 under COMAR 33.16.06.

These proposed regulations will be published in the August 25, 2023 edition of the Maryland Register.

State Board Meeting - December 14, 2023 at 2:00 pm

At its December meeting, the State Board approved:

  1. Regulation .06 under COMAR 33.01.05;
  2. Regulation .01 under COMAR 16.02; and
  3. Regulation .02 under COMAR 33.21.03.

Finally, also at its June meeting, the State Board approved amendments to:

  1. Regulation .05 under COMAR 33.02.03; and
  2. Regulation .03 under COMAR 33.17.05.

Proposed Regulations

August 29, 2023 Board Meeting

A Notice of Proposed Action was published in the August 25, 2023 issue of the Maryland Register for the proposed amendments to:

  1. Regulation .06 under COMAR 33.01.05 Administrative Complaint Procedure
  2. Regulation .01 under COMAR 33.16.02 Provisional Voting Documents and Supplies
  3. Regulation .02 under COMAR 33.21.03 Issuance and Return.

These notices of proposed action are open for a 30 day comment period which will end September 25, 2023. A public hearing has not been scheduled.

Additionally, at its August meeting, the State Board also initiated approved amendments to:

  1. Regulation .06 under COMAR 33.11.02
  2. Regulation .03 under COMAR 33.11.04
  3. Regulation .02 under COMAR 33.15.03
  4. Regulation .04 under COMAR 33.16.06

These proposed actions will be published in the October 27, 2023 Maryland Register and will be open for public comments.

May 4, 2023 State Board Meeting

At its May meeting, the State Board approved: 

1)  New regulations .01 and .05 under COMAR 33.02.03; 

2)  Amendments to Regulation .01 under COMAR 33.12.02; 

3)  New regulation .05 under COMAR 33.13.10; 

4)  Amendments to Regulation .06 under COMAR 33.13.13; 

6)  Amendments to Regulation .06 under COMAR 33.17.04;

7)  Amendments to Regulation .03 under COMAR 33.17.05;

8)  Amendments to Regulation .01 under COMAR 33.17.07;

9)  Amendments to Regulation .01 under COMAR 33.19.01;

10) Amendments to Regulation .01 under COMAR 33.19.02;


A Notice of Proposed Action was published in the June 16, 2023 issue of the Maryland Register for the proposed amendments to Subtitle 13 only, for a 30 day comment period, which concluded on July 17, 2023. For the remaining proposed amendments, a Notice of Proposed Action (PDF) was published in the June 30, 2023 issue of the Maryland Register for a 30 day comment period, which concluded on July 31, 2023.


Additionally, at its May meeting, the State Board also approved: 

1) Amendments to Regulation .01 under COMAR 33.16.02; and 

2) Amendments to Regulation .02 under COMAR 33.21.03. 


These proposed regulations will be published in the August 25, 2023 edition of the Maryland Register.


June 20, 2023 State Board Meeting

At its June meeting, the State Board approved: 

1) Amendments to Regulation .01 under COMAR 33.01.01; 

2) New Regulations .01- .02 under new Chapter 11 under COMAR 33.07; 

3) New Regulations .01- .05 under new Chapter 21 under COMAR 33.13; 

4) Amendments to Regulation .01 under COMAR 33.15.02; 

5) Amendments to Regulations .01 and .02 under COMAR 33.15.03;  

6) Amendments to Regulations .01 under COMAR 33.18.02.  


These changes are included in the Notice of Proposed Action published in the July 28, 2023, issue of the Maryland Register. The deadline to provide comment on these proposed changes is August 25, 2023.


Additionally, at its June meeting, the State Board also approved amendments to Regulation .06 under COMAR 33.01.05. These proposed regulations will be published in the August 25, 2023 issue of the Maryland Register.


Finally, also at its June meeting, the State Board approved amendments to: 

  1. Regulation .05 under COMAR 33.02.03; and 
  2. Regulation .03 under COMAR 33.17.05. 

These minor corrections were included in the Notice of Proposed Action in the June 30, 2023 issue of the Maryland Register. The deadline to provide comment was July 31, 2023.
