The Affidavit Of Limited Contributions and Expenditures and Reporting Schedule
1. What is the Affidavit of Limited Contributions and Expenditures (ALCE)?
The ALCE is an affidavit filed by a political committee stating that the political committee did not receive contributions or make expenditures in the cumulative amount of $1,000 or more (exclusive of the candidate's filing fee) since either the establishment of the political committee, or the filing of the last campaign finance report.
2. When do I have to file the Affidavit of Limited Contribution and Expenditure?
The ALCE must be filed on or before the due date for the campaign finance report to be considered timely. ACLE may be filed late and will be subject to late fees.
3. If the ALCE is filed, do I have future reporting responsibilities?
Yes. The ALCE does not excuse the political committee from future reporting responsibilities. The political committee must either submit a new ALCE or file a campaign finance report at the next reporting period. It is IMPORTANT for you to know that the State Board of Elections (SBE) sends Pre Report Notices to all campaign committees that our records indicate owe a campaign finance report. If you receive a Pre Report Notice, you must either file the ALCE or the campaign finance report. If you believe the notice was sent in error, please immediately contact SBE.
4. What happens when the political committee raises or spends $1,000 or more and previously filed an ALCE?
The political committee must file a detailed and itemized campaign finance report for the next reporting period. The campaign finance report must include all the contributions received and expenditures made covered under the affidavit. For example, your campaign committee filed a ALCE for its initial report, the Pre-Primary 1. And by the time the next report, the Pre-Primary 2, is due, the political committee crossed the $1,000 threshold. The political committee must file a campaign finance report for the Pre-Primary 2 and include the reporting period from the Pre-Primary 1. All contributions received and expenditures made must be reported.
5. Can a political committee file a final report with the ALCE?
Yes, provided that the political committee has only filed ALCE from its inception
